FDA Unsure What Ingredient Causes Loss Of Smell In Zicam

June 23, 2009(by Horatio Algren) According Zicam injury lawyers, the Food and Drug Administration has not identified what ingredient in the three Zicam products that they have issued a warning for.

The warning was issued after more than 130 Zicam users complained to the Food and Drug Administration they had suffered long-lasting or even permanent loss of their sense of smell. Some of these users reported they had loss of smell after their first use of the products, while others used the products or extended amount of time prior to realizing there was a problem with their sense of smell.

The three Zicam products that have been recalled contain zinc derivatives, which include Zincum Gluconium and Zincum Aceticum.

The Zicam products that are manufactured by Matrix Initiatives are sold as homeopathic remedies in retail stores and pharmacies and are not subject to the rigorous testing as many over-the-counter medicines were prescription drugs by the Food and Drug Administration.

Matrix Initiatives has stated through their spokesperson they have stopped shipments of the three products they manufacture after the Food and Drug Administration warning. They also stated that they stand by their products and that the action taken by the FDA is unjustified.

Wrongful Death Suit Filed in Chatsworth Metrolink Crash Case

According to reports the mother of one of the Metorlink 111 Chatsworth crash has filed a lawsuit in the Los Angeles County Superior Court.

The mother, Patricia Hammersley has filed a lawsuit on behalf of her son killed in the Metrolink crash Michael Hammersley. This follows other suites that have been filed in the Los Angeles County Superior Court, who are also listing Veolia Transportation Services Inc. in the suits. This is the company that supplied the engineer in control of the train at the time of the Chatsworth crash, along with Connex Railroad and the estate of Robert M. Sanchez.

Some of the other people who have filed suit for death of family members or injuries are John Freel of Camarillo, Eric Wellington of Moorepark, Phillip Thiele and Frank Kohler of Simi Valley. According to reports there have also been two other suits filed against the regional rail authority and the Metropolitan Transportation Authority.

Woman Involved In Bombing Heads To Federal Court

It is good to be back from good old Dallas to see the attorney, but I almost got in an auto accident there by a DUI driver. Rachelle Carlock allegedly was involved in the bombing at the San Diego Federal Courthouse in May and has not given a clear reason why. Her reasons have gone from “ I think it was put there to send a message” to “ I don’t know why I did it.” Along with blaming the other woman that has also been arrested and charged in the case, Ella Louise “Weezy” Sanders. It should be interesting to see what type of defense that her lawyer puts up in this case. I mean, what will she claim next, that it was all just an accident?
Other than the courthouse bombing the two along with the driver of the get away car Eric Robinson also bombed a FedEx facility in the vicinity of 47th Street and federal Boulevard in the Webster area in March. The first bombing they were allegedly involved in was at a hardware store owned by Barbara Pake. I guess someone really needs a criminal defense attorney over there. Pake contacted the San Diego Fire Rescue Department and spoke with a bomb-squad detective. She has commented that she believes it was two cans of paint that were nearly empty and filled with nails and bolts with a flaming rag. Pake put the fire out with a bucket of water. Chambers County Sheriff Chief Deputy To Serve Time

I just got back from a nice trip to Chicago but I wanted to run some legal news by you. Dearl Hardy, who is the former Chambers County Sheriff Chief deputy, has exhausted all his options and will begin serving a six month sentence. The original charge Hardy was convicted of was perjury and is ordered to surrender himself in the 344th District Court to begin his sentence.
The conviction charges go back to September 2001 when a deputy arrested a resident on a traffic offense and Hardy ordered the deputy to charge the man with driving under the influence. The deputy felt there was no reason for this charge and the man charged Vernon Coates later brought a lawsuit. At least no actual Personal Injury was involved in that incident.
Hardy served under former sheriff Monroe Kreuzer who lost his office when his term was up, due in part to an administration that had numerous lawsuits. Some Attorney must have been busy.
Hardy has exhausted his appeals and the 14th Court of Appeals in Houston reversed his conviction only to have the Court of Appeals then rule against him and the Court of Criminal Appeals refused to hear the case.
Hardy will now spend his six months in the Chambers County Jail where Coates was placed after his arrest. In a statement by the First District Attorney Dan Brady, it was stated that it is good to see the Hardy case settled and the reputation of the department restored. He also commented that Mr. Hardy was a bad officer, even if no personal Injury was involved in that particular case.

Jefferson County Escapee Gets 144 Years For Home Burglaries

I just got back from Houston but i am ready to get back to blogging. Houston was nice but it is time to get to work. An escapee from Community Corrections Center has been found guilty of serial burglary and received a prison sentence of 144 year on Friday. According to reports, David John Heckman aged 32, was found guilty last February of 17 counts of residential home burglary in the Littleton area in Jefferson County. He was also found guilty of 7 counts of aggravated motor vehicle theft, 2 counts of criminal trespassing of an auto and 3 counts of theft by receiving stolen property.
He may have made off with items like Techno Master Watches gold chains, ladies diamond ring, Curtis & Co Watches and the like. I don’t know but those techno master watches are the best. His lawyer was not able to prevent his stiff sentencing in this case.
Heckman had escaped from Community Corrections when he just walked away on his first day and began a two-month crime spree in 2007. He had allegedly burglarized 23 homes during the night while the occupants were asleep. According to Prosecutors, Heckman had entered the homes at night through unlocked windows and open garage doors. He was arrested in a stolen Mercedes on May 2, 2007. Heckman was intoxicated and had attempted to flee troopers when the Mercedes got into an accident. Stolen property was also found inside the car.
According to reports, Jefferson County Investigator Jamie Greaser carried out a search warrant at Heckmans home and found more stolen property.
Heckman now has 11 felony convictions and was also charged with being a habitual or career criminal. Heckman had six juvenile adjudications and 10 adult felony convictions prior to his most recent convictions of burglary.
District Judge Dennis Hall has sentenced Heckman to 144 years in prison where he will spend the rest of his life.
