Tow Truck Driver Charged In Caltrans Accident

Time for more out of state legal news…A tow truck driver who was identified as Louis Estrada Vasquez will stand trial for vehicular manslaughter by the Santa Clara County District Attorneys Office, since the accident in question caused a fatality.
Vasquez was driving a tow truck when he slid due to wet road conditions into a Caltrans work site and struck Sean Merriman. Merriman was working as part of a crew repairing potholes on U.S. 101 in the vicinity of Hellyer Avenue in San Jose. I hope for his sake he has a good attorney.
Vasquez has pleaded not guilty to the charges of manslaughter, if convicted Vasquez could be sentenced up to a year in the county jail. The trial is scheduled to begin in early September and will be held in Department 24 of the Hall of Justice. At the present time according to Jeena Jiampetti the Deputy District Attorney she and the public defender are holding pretrial conferences. Jiampetti stated that the trial is expected to last longer than a misdemeanor trial would usually last. This is not the only legal case Vasquez will be involved in as there has also been a civil suit filed against Vasquez and his former employer Ponzini’s Community Garage by the Merriman family. This begins August 26th with a trial conference between the attorneys representing the family, Vasquez and his former employer.
Sean Merriman was 32 years old and was a resident of Gilroy prior to his death while working with the Caltrans crew.
